Terms of Service

1. About us and these terms

TidyPhotosUp is a service operated from the United Kingdom. By creating an account or using the service you agree to these Terms, which are governed by the law of England and Wales. If you do not agree, please do not use the service.

2. The service

TidyPhotosUp provides free tools and a service that turns a photo you upload into a clean, marketplace-ready product photo while keeping the actual item you are selling. Results are produced by an automated process.

3. Your account

You must give accurate details, keep your login secure, and you are responsible for activity on your account. You must be at least 18, or the age of majority where you live, to buy credits or a plan.

4. How credits work

The service runs on credits. New accounts receive a small number of free credits. One credit is used each time you tidy a photo. If a tidy fails for a technical reason on our side, the credit is returned to your balance automatically. To keep the service available to everyone, fair-use and daily limits and rate limits may apply.

5. Plans, top-ups and payments

Paid plans are monthly subscriptions billed through Stripe that renew automatically until you cancel, and credit top-ups are one-time purchases. The plan’s credits are added to your balance when your subscription renews. Prices are shown at checkout and include VAT where applicable. You can cancel at any time from your billing page to stop future renewals, and prices may change with notice.

6. Your right to cancel

If you are a consumer in the UK, you normally have 14 days to cancel a purchase of digital content under the Consumer Contracts Regulations 2013. Because the service is digital content supplied immediately, when you start using it (for example by tidying a photo or spending credits) you ask us to begin during the cancellation period and you acknowledge that you lose the right to cancel for content that has already been supplied. You can still cancel a subscription to stop future renewals. Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015.

7. Refunds

Where a tidy fails for a technical reason, the credit is refunded automatically as described above. Otherwise, and except for your statutory rights as a consumer, payments and credits that have been used are non-refundable.

8. Acceptable use

You agree that you will:

• only upload images you own or have the right to use;
• keep each tidied result an honest representation of the actual item you are selling;
• not upload unlawful, infringing, harmful or sexual content, or images of other people without their consent;
• not disrupt, scrape, reverse engineer, or resell the service, or try to get around fair-use or rate limits.

9. Your content

You keep all rights in the images you upload and the results you create. You grant us a limited, worldwide licence to host, store and process them, and to transmit them to the providers in our Privacy Policy, solely to provide the service to you. You are responsible for your content and for the listings you publish elsewhere.

10. Our content

The site, software, branding and design are owned by us or our licensors. Using the service does not give you any rights in them beyond using the service as intended.

11. Results and your listings

Results are produced automatically and may vary. We do not guarantee sales, or that a result meets any particular marketplace’s policies. You are responsible for reviewing each result and your own listings before you publish them.

12. Availability and disclaimers

The service is provided on an “as is” and “as available” basis, and we may change or suspend features. We provide the service with reasonable care and skill as required by the Consumer Rights Act 2015; beyond that, and to the extent permitted by law, we do not give other warranties.

13. Our liability

We do not exclude or limit our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, or for fraud. Subject to that, we are not liable for losses that were not reasonably foreseeable, for loss of profit, or for losses arising from your own breach of these Terms, and our total liability to you is limited to the amount you paid us in the twelve months before the claim.

14. Suspension and termination

We may suspend or close accounts that breach these Terms or that put the service or other users at risk. You can stop using the service and close your account at any time.

15. Governing law

These Terms are governed by the law of England and Wales, and disputes are subject to the courts of England and Wales. If you are a consumer living elsewhere in the United Kingdom, you may also bring proceedings in your local courts.
